McALLEN, Texas (AP) -

A Guatemalan diplomat says that seven surviving immigrants from a failed smuggling attempt in South Texas last week agree that the state helicopter that fired on them could have seen there were people, not drugs, in the pickup.
Alba Caceres, Guatemala's consul in McAllen, said Wednesday there was agreement that the Texas Department of Public Safety helicopter was 450 to 600 feet away when a trooper inside fired in an attempt to disable the fleeing vehicle.
Two Guatemalan immigrants were killed. The DPS helicopter was assisting in the pursuit of a pickup Thursday near La Joya. DPS says the crew believed the truck was carrying a load of drugs when it tried to shoot out a tire on a gravel road.
DPS didn't immediately respond to a message seeking comment.
